SoberPro LLC – Terms and Conditions

These Terms and Conditions (“Agreement”) govern the use of designated driver services provided by SoberPro LLC, a Wisconsin limited liability company (“SoberPro,” “we,” “us,” or “our”).
By requesting, scheduling, or using SoberPro LLC services, you (“Customer,” “you,” or “your”) agree to be bound by this Agreement.
1. Scope of Services
SoberPro LLC provides designated driver services, which consist of a qualified driver operating the Customer’s personal vehicle for the sole purpose of transporting the Customer and vehicle to a requested destination.
SoberPro LLC does not provide transportation as a common carrier, rideshare, or taxi service, and does not provide vehicles for hire.
2. Authorization to Operate Vehicle (Permissive Use)
By using our services, you expressly authorize a SoberPro LLC driver to operate your vehicle as a permissive user solely for the duration of the service.
You acknowledge that the driver operates your vehicle with your permission and at your request.
3. Insurance Acknowledgment and Responsibility
You represent and warrant that:
- You maintain a valid automobile insurance policy covering your vehicle at the time of service.
- Your insurance policy permits permissive use by an authorized driver.
- Your insurance policy is primary for any incident arising during service.
SoberPro LLC does not provide automobile liability insurance covering your vehicle. Proof of insurance may be requested at any time.
Failure to maintain valid insurance may result in refusal or termination of service.
4. Exclusions of Liability
To the fullest extent permitted by law, SoberPro LLC shall not be liable for:
- Mechanical failures or vehicle defects, whether known or unknown, occurring before, during, or after service.
- Damage or incidents caused by external conditions, including but not limited to:
- Road or weather conditions
- Road debris
- Wildlife or animal encounters
- Acts of third parties
- Pre-existing damage to the vehicle not disclosed prior to service.
5. Driver Qualifications
SoberPro LLC engages drivers who meet applicable state licensing requirements and are legally authorized to operate motor vehicles.
Drivers carry valid driver’s licenses and may present such documentation upon reasonable request at the time of service.
6. Customer Responsibilities
You agree to:
- Inform the driver of any known mechanical issues or pre-existing damage prior to the start of service.
- Ensure your vehicle is legally operable and safe to drive.
- Provide accurate vehicle and insurance information.
- Notify SoberPro LLC of any changes to vehicle ownership or insurance coverage.
7. Assumption of Risk
YOU ACKNOWLEDGE THAT HAVING A THIRD PARTY OPERATE YOUR VEHICLE INVOLVES INHERENT RISKS.
YOU VOLUNTARILY AND KNOWINGLY ASSUME ALL RISKS ASSOCIATED WITH THE USE OF SOBERPRO LLC’S SERVICES, INCLUDING RISKS OF PROPERTY DAMAGE, PERSONAL INJURY, OR ECONOMIC LOSS.
8. Waiver and Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE THAT SOBERPRO LLC, ITS DRIVERS, MEMBERS, MANAGERS, AGENTS, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY CLAIMS, DAMAGES, OR LOSSES ARISING FROM OR RELATED TO THE SERVICES PROVIDED, INCLUDING CLAIMS BASED ON NEGLIGENCE.
Nothing in this Agreement shall limit liability where such limitation is prohibited by law.
9. Customer Satisfaction & Deductible Reimbursement
If an accident occurs during service and it is officially determined that the Customer’s insured vehicle, while operated by a SoberPro LLC driver, is at fault:
- SoberPro LLC will reimburse 50% of the Customer’s insurance deductible
- Up to a maximum of $500.00, whichever is less
Reimbursement is contingent upon:
- Final fault determination by insurance adjuster or law enforcement
- Submission of supporting documentation
- Confirmation of valid insurance coverage
10. Service Availability & Jurisdictional Compliance
Services are offered only in jurisdictions where permissive use of a customer’s vehicle by an authorized driver is permitted by law.
SoberPro LLC reserves the right to refuse service where local laws, insurance requirements, or safety considerations prohibit operation.
11. Governing Law and Venue
This Agreement shall be governed by the laws of the State of Wisconsin, without regard to conflict of law principles.
Any dispute arising from this Agreement shall be brought exclusively in the state or federal courts located in Wisconsin, and the parties consent to personal jurisdiction therein.
12. Modifications
SoberPro LLC may update these Terms and Conditions from time to time. Continued use of services constitutes acceptance of any revisions.

FAQ – SoberPro Services
Is my insurance used if something happens?
Yes. Your automobile insurance remains primary under permissive use.
Does SoberPro insure my vehicle?
No. SoberPro does not provide insurance coverage for customer vehicles.
What if my car already has damage?
You must disclose pre-existing damage before service begins.
Why Wisconsin law?
SoberPro LLC is a Wisconsin-registered company. Governing law is established for clarity and consistency.
What if I’m in Minnesota?
Services are provided only where permissive use is legally recognized. Minnesota permissive use laws are acknowledged, but Wisconsin law governs the agreement.
